SECTION 76. Excessive demands; penalty

If the mortgagee, pledgee, lienor or conditional vendor, or his assigns, demands and receives more than the amount due to him, he shall be liable to the attaching creditor for the excess, with interest thereon at the rate of twelve per cent a year.
