SECTION 25. Conveyances void as to creditors; persons having property as trustees

A person summoned as trustee having goods, effects or credits of the defendant in his possession by a conveyance or title void as to the creditors of the defendant may be adjudged a trustee, although the defendant could not maintain an action therefor against him.
