SECTION 106. Deposit in lieu of removal bond

Any party, in lieu of filing the bond required in section one hundred and four, may deposit with the clerk the sum of one hundred dollars. A certificate of such deposit shall be issued to the depositor by the clerk, and the deposit shall be transmitted by him, with the papers, to the clerk of the superior court, who shall receipt therefor and hold said deposit until the final disposition of the case, when he shall apply the same to the satisfaction of any costs awarded against the depositor, and pay the balance, if any, to the depositor or his legal representatives.
